January 21, 2014

The Miner County Board of Commissioners met in regular session January 21, 2014, in the Miner County Courthouse.  Members present:  Alex Protsch, Don Bowman, Voni Durant and Roger Wentland.  Absent:  none.  Chairman Wentland called the meeting to order.

                Garrett Gassman took his oath of office to fill the vacant seat on the commission. 

    Motion by Durant, seconded by Bowman and carried to approve the agenda as amended.  The minutes of January 7th and January 9th were approved.

                Commissioners acknowledged correspondence from the following:  Hagan Benefits-SDPAA’s decision for administrative services, SD Department of Veterans Affairs-Operation RAV, and SD State Historical Society-Nansen Store on historical register.

                States Attorney Greg Protsch and Welfare Director Gibi Page presented an offer from Sanford to settle poor relief case 13-02.  Motion by Protsch seconded by Gassman and carried to direct the State’s Attorney to make a counter offer to Sanford in an attempt to settle the case.

                Community Health Nurse Barb Esser presented her quarterly CHN report.  Esser also made a request for a level raise for CHN administrative assistant Gibi Page.  Motion by Bowman, seconded by Durant and carried to move Page from level 7 to level 8.  Motion by Durant, seconded by Protsch and carried to increase Welfare Director Gibi Page wage from $16.24 to $17.00/hr for welfare director hours. 

                Sheriff Lanny Klinkhammer presented his quarterly sheriff’s report. 

                Highway superintendent Ron Krempges presented information on the 2016 asphalt overlay.  Motion by Durant and seconded by Protsch to adopt the following resolution.

RESOLUTION 14-03

                WHEREAS, Miner County desires the construction and improvement of the road and/or bridge as hereinafter described:

                LOCATION, LENGTH, STRUCTURE NUMBER:  from Canova, 8 miles west to SD Hwy #25.  435th Avenue West to SD Hwy #25 8 miles.

                TYPE OF CONSTRUCTION:  2” Asphalt overlay

                Major Collector Route Number – County Road #22 FAS #6242

                AND WHEREAS, Miner County is obligated and hereby agrees to provide proper maintenance as required by the Federal Highway Act as amended and supplemented thereto for the project after construction is completed and to regulate or cause to be regulated the installation of utility facilities within the limits of the right-of way of the proposed project in accordance with State and Federal requirements.

                AND WHEREAS,                Miner County is obligated and hereby agrees to reimburse the State of all costs not reimbursable with Surface Transportation Program (STP) Funds and associated State matching funds.

                NOW THEREFORE BE IT RESOLVED:

                That the SD Department of Transportation be and hereby is authorized and requsted to program for construction, in accordance with the “Local Roads Plan” and the State’s “Standard Specifications for Roads and Bridges,” the project described.

                Estimated Cost of Project Including Engineering:                                   $1,100,000

                STP Funds:                                                                                          $   600,000

                Local Funds                                                                                         $   500,000

                Motion by Bowman, seconded by Gassman and carried to enter into the agreement with the State of South Dakota Department of Transportation for the striping and continuing maintenance of county roads within Miner County. 

                Krempges also presented information on his proposed 7 year plan and the assistance to be provided by the highway department for the construction of the Howard School District track.   

                Motion by Gassman seconded by Durant and carried to purchase datA compromise and identity recovery coverage from Hartford Steam Boiler.

                Emergency Management Director Bob Calmus reviewed information from the recent Miner County Fire Departments meeting. 

                Motion by Bowman and seconded by Protsch to adopt the following resolution.

RESOLUTION 14-04

                WHEREAS, Miner County received assistance in the preparation of the Miner County Pre-Disaster Mitigation Plan 2013-2017 from representatives of Miner County and received funding from the South Dakota Department of Emergency Management/FEMA; and

                WHEREAS, several public planning meetings were held between January 2011 and September of 2013 regarding the development and review of the Miner County Pre-Disaster Mitigation Plan 2013-2017; and

                WHEREAS, the Miner county Pre-Disaster Mitigation Plan 2013-2017 contains several potential future projects to mitigate hazard damage in Miner County; and

                WHEREAS, the Federal Emergency Management Agency (FEMA) has rendered its approval of the Miner County All Hazard Mitigation Plan on December 16, 2013; and

                WHEREAS, a duly-noticed public hearing was held by the Miner County Pre-Disaster Mitigation Team on September 13, 2013 to solicit public comment on the Miner County Pre-Disaster Mitigation Plan 2013-2017; and

                WHEREAS, a duly-noticed public meeting was held by the Miner County Commission on January 21, 2014 to formally approve and adopt the revised Miner County Pre-Disaster Mitigation Plan 2013-2017.

                NOW, THEREFORE, BE IT RESOLVED that the Miner County Commission adopts the Miner County Pre-Disaster Mitigation Plan 2013-2017.

                Motion by Bowman, seconded by Durant and carried to increase the grant to senior citizens groups in Miner County from $.50/member/month to $1.50/member/month.

                Commissioners reviewed the submitted proposal for moving the electric pole and service located on the north end of the courthouse parking lot.  The proposal was tabled.
