The Miner County Board of Commissioners met in regular session May 17, 2016, in the Miner County Courthouse.  Members present:  Roger Wentland, Tom Reisch, Garrett Gassman, Voni Durant and Alex Protsch.  Absent: none.  Chairman Wentland called the meeting to order.  The Pledge of Allegiance was recited.  Motion by Durant, seconded by Gassman and carried to approve the agenda as amended.

The minutes from the May 3rd meeting were approved.

                Commissioners acknowledged receipt of the following correspondence: SD Dept of Transportation – Non approval of 2016 Preliminary Engineering Bridge Improvement Grant applications; East Dakota Water Development District April Minutes; SD Dept of Environment & Ntrl. Resources-Donahue Farms Manure Mgt. Permit & Application Review; and Children’s Care Corner Thank You.

                State’s Attorney Greg Protsch informed the board that an appeal has been filed in 3rd District Court by Judy Shaw Foundation, Inc.  Protsch will not represent the Miner County Board of Equalization due to a conflict of interest.  The commissioners instructed Protsch to secure legal counsel to represent the county with this appeal. 

                It was moved by Durant, seconded by Reisch and carried to enter into the Fiscal Year 2017 WIC Contract with the SD Dept. of Health.  This program provides assistance to women and infants through the Miner County Community Health Nurse Office. 

                Commissioner Reisch informed the board that Miranda Donahue has been hired to fill the clerical position in the CHN office.  The Community Health Office will be open Mondays, Wednesdays and Fridays starting in June.

                A hearing was held as advertised to consider issuance of malt beverage licenses to operate outside of a municipality for the 2016-2017 licensing period.  It was moved by Protsch, seconded by Gassman, and carried to approve the retail on-off sale malt beverage license applications of Harm’s Oil Co. (Friendly’s Fuel Stop-Winfred-Jake’s) for Tract A of Bessman’s First Addition NW ¼ Section 12-106-55 Clearwater Township, and Sandy Scheuren (Coonhunter Inn) for Lot 1 of Lot 3 SW ¼ Section 34-105-57, Rock Creek Township.

                It was moved by Durant, seconded by Gassman and carried to approve the refund application of Howard Industries for Parcel 4511-All of Greenleaf Addition with exceptions, Howard City due to an error in the Director of Equalization’s office in entering the valuation thereof.  The Property square footage was incorrectly calculated when initial plat was developed and approved (2000).  Corrections have been made for year of assessment 2016 payable 2017.  This refund is for the preceding years allowable by law (2012-2015).  Total taxes paid $1982.76 corrected taxes $119.66 for a total refund of $1863.10. 

                The board discussed issues relating to the 2017 budget.
