The Miner County Board of Commissioners met in regular session on September 20, 2022 in the Miner County Courthouse Commission room.  Members present: Alex Protsch, Kari Jo Carlson, Kathy Faber and Joe Bechen.  Absent:  Tom Reisch.  The flag pledge was recited. 

Motion by Faber, seconded by Carlson and carried to approve the agenda.  The minutes of the September 6th meeting were approved. 

The board acknowledged receipt of the following correspondence:  FEMA-Region 8 SD Risk Map Update; Miner Conservation District & NRCS-June reports; SD Bureau of Human Resources SD State Employee Benefits Program; USDA-Agricultural Foreign Investment Disclosure Act of 1978. 

        Commissioner Carlson reported on attendance at the Miner County Ambulance Board meeting.

        No persons attended during Public Comment.

It was moved by Carlson, seconded by Faber and carried to authorize the auditor to advertise the intention of the board to adopt a supplemental budget for 2022. 

It was moved by Bechen, seconded by Carlson and carried to enter into executive session (SDCL 1-25-2 (3)) at 9:21.  Returned to regular session at 9:35.

         It was moved by Faber seconded by Carlson and carried to pass the following resolution.

RESOLUTION 22-32

ADOPTION OF ANNUAL BUDGET FOR MINER COUNTY, SOUTH DAKOTA

            WHEREAS, (7-21-5 through 13) SDCL provides that the Board of County Commissioners shall each year prepare a Provisional Budget of all contemplated expenditures and revenues of the County and all its institutions and agencies for such fiscal year, and

            WHEREAS, the Board of County Commissioners did prepare a Provisional Budget and cause same to be published by law, and

            WHEREAS, due and legal notice has been given to the meeting of the Board of County Commissioners for the consideration of such Provisional Budget and all changes, eliminations, and additions that have been made thereto;

            NOW THEREFORE BE IT RESOLVED that such provisional budget as amended

and all its purposes, schedules, appropriations, amounts, estimates, and all matters therein

set forth SHALL BE APPROVED AND ADOPTED AS THE ANNUAL BUDGET OF THE

APPROPRIATION AND EXPENDITURES FOR MINER COUNTY, SOUTH DAKOTA,

and all its institutions and agencies for calendar year beginning January 1, 2023, and ending

December 31, 2023, and the same is hereby approved and adopted by the Board of

County Commissioners of Miner County, South Dakota, this 20th day of September, 2022. 

            The Annual Budget so adopted is available for public inspection during normal business

hours at the office of the county auditor, Miner County, South Dakota.  The

accompanying taxes are levied by Miner County for the year January 1, 2023, through

December 31, 2023.

            Ron Krempges and Amie Kidd joined the meeting.  Greg Vavra of SD LTAP (Local Technical Assistance Program) provided information concerning the Rural Access Infrastructure program for townships.  The board will consider revising the township/fund cost share at the October 1st meeting.  Currently it had been set at 70/30.  The board will consider changing to an 80/20 share.

            Krempges informed the board of highway matters including blading, mowing, gravel crushing and bridge grant programs.

            Todd Kays of First District of Local Govts reviewed proposed changes/updates to the zoning ordinance.  Further review will take place at the October 18th meeting.

            Brittany Yanish provided the CHN quarterly update, stepping in for CHN Kayla Miller.  The request for clerical support from Miner County to Lake County did not have to be considered as the Lake County position has been filled. 

            Director of Equalization Tami Severson presented the following plat for consideration.  It was moved by Carlson and seconded by Bechen to adopt the following resolution.

RESOLUTION 22-33

            BE IT RESOLVED by the Board of County Commissioners of Miner County, South Dakota, that the plat of HANSON TRACT 1, A SUBDIVISION OF THE SW ¼ OF SECTIOIN 25, T 108 N, R 55 W OF THE 5TH P.M., MINER COUNTY, SOUTH DAKOTA, which has been submitted for examination pursuant to law, is hereby approved and the County Auditor is hereby authorized and directed to endorse on such plat a copy of this Resolution and certify the same.  Voting aye:  Protsch, Carlson, Faber and Bechen.  Voting nay:  none.  Resolution adopted this 20th day of September, 2022.

            No information was received from insurance agent Curt Neises concerning the hotel’s fire alarm system.  This matter will be placed on the October 1st agenda.

            It was moved by Bechen and seconded by Carlson to adopt the following resolution. 

RESOLUTION 22-34

            WHEREAS, insufficient appropriation was made in the 2022 budget for the following department to discharge just obligation of said appropriation; and

            WHEREAS, SDCL 7-21-32.2 provides that transfers may be made by resolution of the board from the contingency appropriation established pursuant to SDCL 7-21-6.1 to other appropriations;

            THEREFORE, BE IT RESOLVED that the appropriation be transferred from contingency to the following department:  Abused/Neglect Child Defense $8,115. 

Voting aye:  Bechen, Carlson, Faber and Protsch.  Voting nay:  none.  Resolution approved this 20th day of September 2022.

It was moved by Faber, seconded by Bechen and carried to authorize the auditor to make automatic supplements for expenditures associated with the property damage from the wind storms to the following departments Courthouse Repairs $15,234.09; Highway Office Repairs $20,483.43; Tax Deed Hotel Repairs $6884.70.
