              The Miner County Board of Commissioners met in regular session October 4, 2016 in the Miner County Courthouse.  Members present:  Roger Wentland, Tom Reisch, Garrett Gassman, Voni Durant, and Alex Protsch.  Absent:  none.  Chairman Wentland called the meeting to order.  The Pledge of Allegiance was recited.  Motion by Durant, seconded by Protsch and carried to approve the agenda as amended.

 

              The minutes of the September 20th meeting were approved.

 

              The Auditor’s account with the County Treasurer showed a September 30, 2016 balance of $5,504,516.23 in all state, county, civil, school, and trust accounts.

 

              The board adjourned as a board of commissioners and reconvened as a planning commission acting as a board of adjustments.  Planning Chairman Protsch called the planning commission meeting to order.  A hearing was held as advertised to consider granting a conditional use permit from Landon & Kaitlyn Lee to construct and operated a repair shop located on Tract 1 Inga’s Addition in the North West (NW) ¼ of Section 27, T108N, R56W, Grafton Township, Miner County, South Dakota.

 

              Those present included Zoning Administrator Tami Severson, Landon Lee, and Chloe & Mads Andenas.

 

              No person appeared in opposition.   Following consideration of materials presented, it was moved by Wentland and seconded by Durant that the following findings be approved.

FINDINGS

 

I

            That the applicants, Landon & Kaitlyn Lee have made an application for a conditional use to construct and operate a repair shop located on Tract 1 Inga’s Addition in the North West (NW) ¼ of Section 27, T108N, R56W, Grafton Township, Miner County, South Dakota.

II

            That the proposed use of said realty is specifically prohibited by the zoning ordinance without applicant first obtaining a conditional use, for which they have applied.

 

III

            That upon said application, notice of hearing was given as required by the Miner County Zoning Ordinance by mailing to the adjoining landowners and by publication.

 

IV

            That hearing upon said application was held on October 4, 2016 in the Commissioners’ Room of the Miner County Courthouse.

 

V

            That the applicant, Landon Lee was present.

 

VI

            That Mads & Chloe Andenas appeared in support and that no residents appeared in opposition. 

 

VII

            That a presentation in support of said conditional use and testimony on behalf of said conditional use was received at the hearing and that no testimony in opposition to the granting of the conditional use was received at the hearing. 

 

            NOW, THEREFORE, that application, testimony at the hearing, and arguments of individuals at the hearing all having been considered, it is the FINDING of the Miner County Board of Adjustment that the application of Landon & Kaitlyn Lee for a conditional use be approved for the following reasons:

  1. That the Miner County Board of Adjustment is empowered under Section 505 of the Miner County Zoning Ordinance to grant with conditions the conditional use and that the granting of the conditional use will not adversely affect the public interest.

  2. That the Miner County Board of Adjustment certifies compliance with the specific rules governing individual conditional uses.

  3. That the Miner County Board of Adjustment is able to make the applicable findings required by Section 505, Subsection 5 of the ordinance, which are considered prerequisite to the granting of a conditional use.

     

    VIII

                That the Board of Adjustment vote upon approval of such application was five in favor thereof and none opposed thereto.

                It is, therefore, ORDERED that said application be approved.

                The board adjourned as a planning commission and reconvened as a board of commissioners.                                                                                                                                                  

                Board member Protsch briefed the commission on a request from Evan Meyer with the SD Game, Fish and Parks.  His department is working on a plan to install a fishing dock at Lake Carthage and would like the county to assist with the project by providing a skid steer to move dirt and rock.  The board instructed the auditor to check on insurance coverage and liability for assistance with such a project.                                                                                                                                                               

                Highway superintendent Ron Krempges presented the following resolution for consideration.  It was moved by Gassman and seconded by Reisch to adopt this resolution.

    RESOLUTION 16-23

     

    A RESOLUTION ADOPTING THE MINER COUNTY FIVE-YEAR HIGHWAY AND

    BRIDGE IMPROVEMENT PLAN

     

          WHEREAS, the South Dakota Department of Transportation Local Bridge and Improvement Grant Fund requires that in order to be eligible to apply for Bridge Improvement Grant funds, Counties are required to develop a five-year Highway and Bridge Improvement Plan, hereinafter referred to as Plan; and

          WHEREAS, Miner County has utilized the South Dakota Department of Transportation, County Staff, the First District Association of Local Governments, Townships, and the general public in developing the various components of the Plan; and

          WHEREAS, the Plan includes maps and lists identifying an inventory of highways and bridges, project needs, and revenue sources; and

          WHEREAS, Miner County held a public meeting on September 6, 2016 to solicit input into the Plan, and the citizens who attended expressed an interest in the Plan; and

          WHEREAS, the County will be able to use the Plan as a tool to budget for transportation enhancements and better coordinate transportation issues with other entities;

          NOW, THEREFORE, BE IT RESOLVED BY THE MINER COUNTY BOARD OF COUNTY COMMISSIONERS THAT THE MINER COUNTY FIVE-YEAR HIGHWAY AND BRIDGE IMPROVEMENT PLAN IS HEREBY ADOPTED AND IS RECOGNIZED AS THE HIGHWAY AND BRIDGE IMPROVEMENT PLAN FOR MINER COUNTY.

          Voting aye:  Wentland, Protsch, Durant, Reisch and Gassman.  Voting nay:  none.  Resolution adopted at Howard, South Dakota this 4th day of October, 2016.

                Krempges also reviewed other highway matters.

                The auction of the lease of the farmable portion of the SW ¼ of Section 4-106-56, Howard Township, consisting of 150.9 acres, known as the county farm, was held as advertised. Present for the auction were Mark & Ben Wipf of Shannon Colony, Brian Kizer, Dale Schwader, Jason Clark, Randy Nielsen, Jason Feldhaus with Reisch Farms, Jerry Calmus and Dave Miller.  The lease was awarded to Reisch Farms, Inc. for $23,000. Reisch Farms chose a three year lease, beginning February 1, 2017.

    Miranda Donahue, staff support for the Miner County CHN office, reported that flu vaccinations through their office will be available with a cost of $45/vaccination.  Commissioners encourage all county employees and volunteer EMTs to visit the CHN office for their flu vaccination.  The cost for the vaccination will be covered by Miner County. 

                  Colleen Arens reviewed several maintenance issues within the courthouse.
