The Miner County Board of Commissioners met in regular session April 18, 2017 in the Miner County Courthouse. Members present: Roger Wentland, Tom Reisch, Garrett Gassman, and Alex Protsch. Absent: Voni Durant. Chairman Wentland Called the meeting to order. The Pledge of Allegiance was recited. Motion by Gassman, seconded by Reisch and carried to approve the agenda as amended.
The minutes of the April 4th and April 11th meeting were approved.
The board acknowledged receipt of the following correspondence: SD DOT Open House/Public Meeting for Hwy 34 from Sanborn/Miner County Line to 425th Ave.; Kristian Ellendorf Rural Practice Program; Denim Day Campaign for Mitchell Area Safehouse and Miner County Ambulance 2016 Annual Report.
Treasurer Pat Carmon addressed the commission as to the method that was used to determine her beginning wage. The board will put this on the June 6th agenda to be reviewed after the County Wage Survey is received from the SD Association of County Officials.
Tami Severson presented the following plat for consideration. It was moved by Gassman and seconded by Reisch to adopt the following resolution.
RESOLUTION 17-14
BE IT RESOLVED that the Plat of LOT 1 OF DOLLAR GENERAL ADDITION IN THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 12, TOWNSHIP 106 NORTH, RANGE 56 WEST OF THE 5TH PRINCIPAL MERIDIAN, MINER COUNTY, SOUTH DAKOTA, as described above appears to conform to the system of roads, existing plats, and section lines of Miner County and that adequate provisions has been made for access to adjacent unplatted lands and that all provisions of Miner County Subdivision Regulations have been complied with. Furthermore, all taxes and special assessments upon the Tract or subdivision have been paid and that the plat and the survey thereof have been lawfully executed. Said plat is approved and accepted and the Chairman is hereby instructed to endorse on such plat this resolution and to certify the same. Voting aye: Gassman, Reisch, Protsch and Wentland. Voting nay: none. Dated this 18th day of April 2017.

Clinton Township Clerk Vicki Vining joined the meeting. It was moved by Gassman, seconded by Protsch and carried unanimously to declare the following properties as surplus:
N ½ Lot 1, Block 1, Fedora Village OP 9-106-58;
Lots 4 & 5, Block 1, Kieffer’s Addition Fedora Village 10-106-58
Lots 1, 2 & 3, Block 2, Kieffer’s Addition Fedora Village 10-106-58
It was moved by Gassman, seconded by Reisch and carried unanimously to transfer ownership of the above mentioned properties by quit claim deed to Clinton Township.
The board reviewed the proposal from Connecting Point for technology update costs for network security.
Highway Superintendent Ron Krempges reported on the progress of the county-wide signing project; gravel testing and fencing options for the county owned farm ground west of Howard.
It was moved by Gassman, seconded by Protsch and carried to enter into executive session to discuss personnel matters (SDCL 1 -25-2 (1)) 10:40. The board came out of executive session at 10:56.
Gassman left the meeting but joined telephonically. Todd Kays, Executive Director of First District of Local Governments, joined the meeting to review the current Miner County Personnel Policy. Kays will return with suggested changes in May. Gassman left the meeting.
Emergency Management Director Bob Calmus presented the PDM Plan for Miner County. It was moved by Protsch and seconded by Reisch to adopt the following resolution.
RESOLUTION 17-15
BE IT RESOLVED that Roger Wentland is hereby authorized to execute for and on behalf of Miner County, a public entity established under the laws of the State of South Dakota, this application and to file it with the Division of Emergency Management for the purpose of obtaining Federal financial assistance under the Disaster Relief Act (Public Law 93-288 as Amended), or otherwise available from the President’s Disaster Relief Fund.
That Miner County, a public entity established under the laws of the State of South Dakota, hereby authorizes its agent to provide to the State and to the Federal Emergency Management Agency, for all matters pertaining to such Federal disaster assistance, the assurances attached to the project application.
Voting aye: Protsch, Reisch and Wentland. Voting nay: none. Resolution adopted this 18th day of April, 2017.

A letter was presented from the SD Department of Public Safety concerning civil disturbance situations like the civil disturbance that happened in North Dakota in conjunction with the protest of the Dakota Access Pipeline. The state is suggesting that a local Civil Disturbance Annex guide be added to Miner County’s Local Emergency Operations Plan. Calmus will gather further information as to the requirements and report back to the commission.
Calmus addressed the board concerning the earning of compensatory time as when spraying weeds in the spring and fall he accrues approximately 15-20 hours a week. The board authorized Calmus to go above the 20 hour maximum for compensatory time while carrying out his spraying duties. He also voiced concern as to the new policy requiring employees to use compensatory time prior to using vacation leave. This policy will be discussed further at the commission meeting to be held on May 2nd.
