              The Miner County Board of Commissioners met in regular session September 5, 2017 in the Miner County Courthouse.  Members present:  Roger Wentland, Tom Reisch, Garrett Gassman, Voni Durant, and Alex Protsch.  Absent:  none.  Chairman Wentland called the meeting to order.  The Pledge of Allegiance was recited.  Motion by Gassman, seconded by Protsch and carried to approve the agenda.

 

              The minutes of the August 15th meeting were approved.

 

              The Auditor’s account with the County Treasurer showed an August 31, 2017 balance of $5,886,180.15 in all state, county, civil, school, and trust accounts.

Correspondence received and reviewed included:  June & July 911 & Sheriff’s Reports and SD DENR Shannon Colony Site Plan Review.

              It was moved by Durant, seconded by Reisch and carried to approve the 2018 SLA agreement with the SD Dept. of Public Safety for preparedness for natural and man-made disasters within Miner County.

Spraying of the north courthouse lawn will now need to be sprayed for weeds by a commercial applicator. 

 

              The board recessed as a Board of Commissioners and reconvened as a Planning Commission acting as a Board of Adjustments.  Chair Alex Protsch called the meeting to order.  A hearing was held, as advertised, to consider an application for a variance from the zoning ordinance from Shawn & Shelley Callies to plat a parcel at approximately 2.8 acres including right of way which is smaller than current zoning allows (5 acres plus right of way) and to establish a property line closer than 50 feet to an accessory building in the parcel described as E 41 Rods of N 41 Rods of SE ¼ of Section 19, T106N, R56W, Howard Township, Miner County, South Dakota. 

Shawn Callies & Tate Windedahl explained plans for the future use of the proposed site.  Callies is making the request so that the residential portion of the property can be platted.  Zoning Administrator Severson informed the board that currently there are separate driveways giving access to the residential portion and to the remaining property.  Callies informed the commission that the remaining buildings are currently being repaired, renovated or removed. 

 

              It was moved by Wentland and seconded by Gassman that the following Findings be approved.

FINDINGS

 

I

            That the applicants, Shawn & Shelley Callies, have made an application for a variance to plat a parcel at approximately 2.8 acres including right of way which is smaller than current zoning allows (5 acres plus right of way) and to establish a property line closer than 50 feet to an accessory building in the parcel described as E 41 Rods of N 41 Rods of SE ¼ of Section 19, T106N, R56W, Howard Township, Miner County, South Dakota and that they are the owner of record thereof.

 

II

            That the proposed use of said realty is specifically prohibited by the zoning ordinance without applicant first obtaining a variance, for which they have applied and paid the applicable fee.

 

III

            That upon said application, notice of hearing was given as required by the Miner County Zoning Ordinance by mailing to the adjoining landowners and by publication.

 

IV

            That hearing upon said application was held on September 5, 2017, in the Commission Room of the Miner County Courthouse.

 

V

            That applicant, Shawn Callies, and Tate Windedahl appeared in person.

 

VI

            That no person appeared in objection to granting the variance.

 

VII

            That a presentation in support of said variance and testimony on behalf of said variance was received at the hearing and that no testimony in opposition to the granting of the variance was received at the hearing.

 

            NOW, THEREFORE, that application and testimony at the hearing all having been considered, it is the FINDING of the Miner County Board of Adjustment that the application of Shawn & Shelley Callies for a variance be approved to allow platting a parcel at approximately 2.8 acres including right of way which is smaller than current zoning allows and to allow the establishment of a property line closer than 50 feet to an accessory building for the following reasons:

 

1)      That the Miner County Board of Adjustment is empowered under Section 506 to grant the variance and that the requirements of the zoning ordinance regarding a variance have been met by the applicant.

2)      That the Miner County Board of Adjustment is able to make the applicable findings required by Section 506 of the ordinance, which are considered prerequisite to the granting of a variance.

 

VIII

                 That the Board of Adjustment vote upon approval of such application was five in favor thereof and none opposed thereto.

 

It is, therefore, ORDERED that said application be approved.

            The board adjourned as a Planning Commission and reconvened as a Board of Commissioners.

Severson presented the following plats for consideration.  It was moved by Reisch and seconded by Durant to approve the following resolution.

 

RESOLUTION 17-27

 

            BE IT RESOLVED by the Board of County Commissioners of Miner County, South Dakota, that the plat of BICKETT CONSERVATION EASEMENT TRACT 2-A IN THE SW ¼ OF SECTION 13, T108N, R55W OF THE 5TH P.M., MINER COUNTY, SOUTH DAKOTA, which has been submitted for Resolution and certify the same.

 

            Voting aye:  Reisch, Durant, Protsch, Gassman and Wentland.  Voting nay:  none.  Resolution adopted this 5th day of September, 2017.

            Voting aye:  Reisch, Durant, Protsch, Gassman and Wentland.  Voting nay:  none.  Resolution adopted this 5th day of September, 2017.

            The board reviewed correspondence from the US Census concerning Boundary Annexation Reporting.  It was confirmed to leave the current reporting process in place.

 

            The 2018 Provisional Budget hearing was held as advertised.  No additional persons were in attendance.  Final adoption will be on September 26th.

 

            Highway Superintendent Ron Krempges reported that he has hired two individuals to work within his department.  Isaiah Glanzer and Eric Smith will begin work on September 18th.  Krempges requested that the 2005 CAT 140H Motorgrader be declared surplus so that it may be advertised for sale.  It was moved by Durant, seconded by Gassman and carried that the 2005 CAT 140H Motorgrader be declared as surplus & advertised for sale as being no longer necessary, useful or suitable for the purpose for which it was acquired. Krempges will gather 3 property owners to appraise the motorgrader and advertise for sale.

 

            A previous request from Reisch Farms for cleaning of a ditch on the county owned farm land was considered after receiving advice from the State’s Attorney’s office.  The board shall allow the cleaning of the ditch provided the Lessee obtain assurances from the local NRCS office and that written verification be provided.  Also the Lessee must sign an Indemnification agreement to assure the county that any claims or damage done will be the sole responsibility of the Lessee.  As far as the request for installation of tile, the county shall not grant that request as at the time of the lease being advertised and awarded the land was not advertised and offered as tiled.

 

            The public meeting for consideration of the Miner County 5 Year Highway Plan was held as advertised.  Those present included all five Miner County Commissioners, Highway Superintendent Ron Krempges and Auditor Susan Connor.  Information will be forwarded to First District of Local Govts. for the final plan that will be considered for adoption at the October 3rd  commission meeting.

 

            The meeting was adjourned until September 26th.  Dated this 5th day of September, 2017.
