The Miner County Board of Commissioners met in regular session March 16, 2021 in the Miner County Courthouse. Members present: Roger Wentland, Garrett Gassman, Tom Reisch, Kathy Faber and Alex Protsch. Absent: none. Chairman Protsch called the meeting to order. The Pledge of Allegiance was recited. Motion by Wentland, seconded by Faber and carried to approve the agenda. The minutes of the March 2nd meeting were approved. No conflict of interest was declared.
Public Comment - Brittany Yanish informed the commission the 4-H Youth Office has received an application from Mike Clark to rent the 4-H grounds for his swine sale scheduled for April 24th. Clark will provide proof of liability insurance to the county.
The board heard the updated plans for the courthouse offices move to the temporary facility.

The board heard the updated plans for the courthouse offices move to the temporary facility.
The commission considered the supplemental budget to General Fund Government Building as advertised. Motion by Wentland and seconded by Gassman to adopt the following resolution.
RESOLUTION 21-08
ADOPTION OF SUPPLEMENTAL BUDGET FOR MINER COUNTY
WHEREAS, SDCL 7-21-22 provides that the Board of Commissioners, in the event of the failure to provide by the final budget a sufficient appropriation to enable the county to conduct the indispensable functions of government, may make, approve, and adopt a supplemental budget providing therein for an appropriation for such purposes; and
WHEREAS, notice has been given of the board's intention to make and adopt such supplemental budget, along with the time and place when the same will be considered and adopted by the governing board, by posting at the front & back door of the courthouse and by publication;
THEREFORE, BE IT RESOLVED that such supplemental budget, Government Building Repairs $2,000,000 and Government Building Professional Services $230,000 Government Building Rent $20,000 shall be approved and adopted as a supplemental budget to the 2021 annual budget for Miner County, South Dakota.

It was moved by Gassman, seconded by Durant and carried to authorize the auditor to make an operating transfer as provided for in the 2021 budget to Emergency Management $20,000.
State’s Attorney Kristian Ellendorf joined the meeting telephonically. Ellendorf requested permission to make arrangements for a site to hold scheduled jury trials. The board granted her permission to arrange a suitable site. Sheriff Eggert joined the meeting. Ellendorf and Eggert shared information on the survey for court security. Grant funds are available through the SD Supreme Court. Eggert will explore costs and complete an application to request the grant funds to complete security upgrades to the courthouse.
Highway Superintendent Ron Krempges presented information on the 2021 Local Federal Bridge Replacement Program. It was moved by Gassman and seconded by Reisch to adopt the following resolution.
RESOLUTION 21-09
WHEREAS, Miner County desires the replacement of the bridge hereinafter described: 49-062-020, West edge of Carthage adjacent landowners: City of Carthage, Randy Lager & Opel Clites, and
WHEREAS, Miner County is obligated and hereby agrees to provide proper maintenance as required by the Federal Highway Act as amended and supplemented thereto for project after construction is completed and to regulate or cause to be regulated the installation of utility facilities within the limits of the right-of-way of the proposed project in accordance with State and Federal requirements, and
WHEREAS, Miner County is obligated and hereby agrees to reimburse the State for all costs not reimbursable with Federal Bridge Funds, and
WHEREAS, the bridge is in need of replacement for the following reasons:
1. The condition rating is POOR
2. For Replacement project the bridge is not located on a County or Township designated No Maintenance or Minimum Maintenance Road.
3. For Removal project the bridge location will not be eligible for federal or state bridge funds in the event that a bridge is reconstructed. The owner agrees to submit a separate resolution to delete the structure from the National Bridge Inventory upon completion of the project.
4. The bridge is located on a Federal Aid Route, a school bus route, a mail route, a field to farm to market route.
5. The load carrying capacity of the existing bridge cannot be improved to carry legal loads by rehabilitation of the existing bridge.
NOW THEREFORE BE IT RESOLVED, that the South Dakota Department of Transportation be and hereby is authorized and requested to program for construction, in accordance with the “local Roads Plan” and the State’s “Standard Specifications for Roads and Bridges,” the bridge project at the above-described location. Items to be handled by State forces with Federal Participation will include hydraulic study review, foundations investigation (if necessary), plan reviews, and construction administration.
Estimated Cost of Project Including Engineering $1,200,000; Federal Share (81.95%): $983,400; Local Share (18.05%) $216,600.
Voting aye: Wentland, Faber, Gassman, Reisch and Protsch. Voting nay: none. Resolution adopted this 16th day of March, 2021.

It was moved by Wentland and seconded by Faber to adopt the following resolution.
RESOLUTION 21-12
WHEREAS, 23 CFR 650 Subpart C, requires initial inspection of all bridges and reinspection at intervals not to exceed two years with the exception of reinforced concrete box culverts that meet specific criteria. These culverts are reinspected at intervals not to exceed four years.
THEREFORE, Miner County is desirous of participating in the Bridge Inspection Program using Bridge Replacement funds.
The County requests SDDOT to hire Ulteig Engineers, Inc. for the inspection work. SDDOT will secure federal approvals, make payments to the Consulting Engineer for inspection services rendered, and bill the County for 20% of the cost. The County will be responsible for the required 20% matching funds.

Krempges reported on a truss bridge located in Rock Creek Twp. located between section 29 and section 30. This bridge has been closed to traffic due to its condition. It was moved by Wentland, seconded by Reisch and carried to remove the bridge due to its condition and the county’s liability.
The City of Howard would like to level the ground located in the park west of the courthouse. The board granted permission for the city to complete the work.
Sheriff Rob Eggert made a request to hire a part-time law enforcement officer. The board gave permission to allow Eggert to advertise for the position. Eggert also made requests for the following pay raises. Hahn would receive an increase when he completed his required state training. Eggert requested Hahn receive this increase early. The board will grant the increase once his training has been completed. He also made a request for pay increases within his department. The board informed Eggert that no pay increase requests (excluding level increases) will be granted in 2021. Eggert also requested permission to purchase new office furniture. The board informed him to wait until 2022 budget planning.
Brittany Yanish of the 4-H Youth office. Yanish made a request for rodent control services at the 4-H exhibit hall. She was instructed to get quotes for this service and report back to the board.
Having no further business, the board adjourned until April 13th. This meeting will be held at the Miner County 4-H Exhibit Hall. Dated this 16th day of March, 2021.
