The Miner County Board of Commissioners met in special session December 29, 2022 in the Miner County Courthouse. Members present: Joe Bechen, Tom Reisch, Kari Jo Carlson, Kathy Faber and Alex Protsch. Absent: none. Also present included Director of Equalization Tami Severson. The Pledge of Allegiance was recited. Chairman Protsch called the meeting to order. It was moved by Faber, seconded by Bechen and carried to approve the agenda.

Auditor Connor requested a level increase for Deputy Mommaerts. It was moved by Bechen, seconded by Carlson and carried to move Rebecca Mommaerts from Level 8 to Level 9 effective January 1, 2023.
It was moved by Faber, seconded by Carlson and carried unanimously to revert the capital outlay designations of 2022 Motorgrader $400,000; 2023 Front End Loader $200,000; and 2026 Asphalt Overlay $360,000 back to General Fund Balance Unassigned.
It was moved by Reisch and seconded by Faber to adopt the following resolution.
RESOLUTION 22-42
WHEREAS, SDCL 7-21-51 allows the board of commissioners to authorize the accumulation of funds for a period longer than one year for capital outlay purposes:
THEREFORE, BE IT RESOLVED that the Miner County Board of Commissioners set forth funds from the General Fund for capital outlay accumulation as follows: $390,000 Motor Grader in 2024 and $100,000 Truck Tractor in 2025. Voting aye: Reisch, Carlson, Protsch, Faber & Bechen. Voting nay: none. Resolution adopted this 29th day of December 2022.

Commission Chairman Alex Protsch presented certificates for years of service to the following employees: Ten Year of Service Jennifer Bolden, Joni Jacobsen, Becki Mommaerts and Tami Severson. 15 Years of service Randy Schwader. 40 Years of Service Cora Schwader. The board thanked them for their dedication to Miner County.
Kari Jo Carlson was recognized for her service on the Miner County Board of Commissioners. Protsch presented Carlson with a plaque and along with the board thanked her for all her work and dedication to the commission and the citizens of Miner County.
It was moved by Bechen and seconded by Carlson to adopt the following resolution.
RESOLUTION 22-43
ADOPTION OF SUPPLEMENTAL BUDGET FOR MINER COUNTY
WHEREAS, SDCL 7-21-22 provides that the Board of Commissioners, in the event of the failure to provide by the final budget a sufficient appropriation to enable the county to conduct the indispensable functions of government, may make, approve, and adopt a supplemental budget providing therein for an appropriation for such purposes; and
WHEREAS, notice has been given of the board's intention to make and adopt such supplemental budget, along with the time and place when the same will be considered and adopted by the governing board, by posting at the front & back door of the courthouse and by publication;
THEREFORE, BE IT RESOLVED that such supplemental budget, TAX DEED PROPERTY HHCC $40,000; OPERATING TRANSFER TO 911 $50,000; 911 $50,000 shall be approved and adopted as a supplemental budget to the 2022 annual budget for Miner County, South Dakota.

It was moved by Carlson, seconded by Reisch and carried to enter into executive session (SDCL 1-25-2 (1)) at 12:02. The board returned to regular session at 12:25.
It was moved by Faber and seconded by Carlson to approve the following resolution.
RESOLUTION 22-44
WHEREAS, insufficient appropriation was made in the 2022 budget for the following departments to discharge just obligation of said appropriation; and
WHEREAS, SDCL 7-21-32.2 provides that transfers may be made by resolution of the board from the contingency appropriation established pursuant to SDCL 7-21-6.1 to other appropriations;
THEREFORE, BE IT RESOLVED that the appropriation be transferred from contingency to the following departments: Commissioners $13,600; Auditor $1750; Govt. Building $ 10,000; Director of Equalization $3,100; Veteran Services $225; GIS $300; Jail $5,100; Community Health Nurse $250; Community Action $.04; Weed $4,500 and 911 $2000.
Voting aye: Bechen, Reisch, Carlson, Faber and Protsch. Voting nay: none. Resolution approved this 29th day of December 2022.

It was moved by Bechen, seconded by Faber and carried to authorize the auditor to make automatic supplements for storm damage-Road & Bridge $3,339.01; Govt. Building $11,783.84; Tax Deed Property HHCC $12,048.30 and for B.I.G. funds $216,578.50.
It was moved by Reisch, seconded by Carlson and carried to authorize the auditor to make the following operating transfer as provided for in the 2022 budget from General Fund to 911 $25,000.
As the coroner position is up for appointment in 2023, the board instructed the auditor to advertise the position. This appointment would be for the remaining 2 years of a 4-year elected position. No specified qualification for this appointment with the exception that the appointed Coroner would be required to obtain education and certification at a workshop which is held annually. The board shall appoint an interim coroner until the position is officially filled.
