The Miner County Board of Commissioners met in regular session on February 15, 2022 in the Miner County Courthouse Commission room. Members present: Alex Protsch, Kari Jo Carlson, Kathy Faber, Tom Reisch and Joe Bechen. Absent: none. The flag pledge was recited. Tami Severson, Gibi Page, Kent Terwilliger and Jessica Charles were also present for portions of the meeting. Motion by Reisch, seconded by Faber and carried to approve the agenda.
The minutes of the February 1st & 8th meetings were approved.
The auditor’s account with the county treasurer showed a January 31, 2022 balance of $5,322,690.59 in all state, county, civil, school and trust accounts.

A public auction was held as advertised of Lots 1 & 2 Block 26 Vilas Village, Miner County SD. Present for the auction included Jeff Rubenstein and Kent Terwilliger. Chairman Protsch opened the bidding at $30.62 (unpaid tax amount). The board awarded the sale of the property to Jeff Rubenstein for $100. A quit claim deed will be prepared and filed.
Director of Equalization Tami Severson presented the following plat for consideration. It was moved by Reisch and seconded by Bechen to approve the following resolution.
RESOLUTION 22-07
BE IT RESOLVED by the Board of County Commissioners of Miner County, South Dakota, that the plat of LOTS 1 AND 2 OF KOEPSELL ADDITION IN THE NE ¼ OF SECTION 36, T 105 N, R 56 W OF THE 5TH P.M., MINER COUNTY, SOUTH DAKOTA, which has been submitted for examination pursuant to law, is hereby approved and the County Auditor is hereby authorized and directed to endorse on such plat a copy of this Resolution and certify the same.
Voting aye: Reisch, Carlson, Faber, Bechen and Protsch. Voting nay: none. Resolution adopted this 15th day of February, 2022.

A request to permit aircraft to land on Miner County highways was received from Wilbur-Ellis Air. Commissioner Carlson informed the board that the codified law that was stated on the request had been repealed in 2019. The request was tabled until the March 1st meeting so that State’s Attorney Ellendorf has time to review the request.
Deputy Auditor Rebecca Mommaerts gave an overview of how the reimbursement for the last $2,000 of an individual’s out-of-pocket maximum on Miner County’s healthcare plan through Wellmark has been applied with regard to the family out-of-pocket maximum since its inception on December 19, 2017. The way the reimbursement was set up can mean different reimbursement amounts for the same out-of-pocket dollar amounts, depending on family composition and the distribution of dollars spent on healthcare between those family members. The Commissioners asked for further research to be done on the issue and for possible solutions to be presented to them at the next Commissioner meeting.
Emergency Management Director Kent Terwilliger hand out invitations to the commissioners and auditor for the Annual Equalization Materials Meeting. At this meeting township officials, emergency management officials, and highway superintendents will receive valuable information pertaining to emergency management, equalization, and Rural Access Infrastructure program. Terwilliger also reported he is working on classes to complete his Advance Professional Series.
Deputy Auditor Mommaerts requested clarification on payroll changes made at the February 8th meeting. Gibi Page is a fulltime employee with wages split between Register of Deeds, Ambulance, and Welfare. Gibi’s wages for Register of Deeds and Ambulance fall on the level scale, and were therefore increased by $0.75 per hour at the February 8th meeting. However, her wages as Welfare Director are separate since she is the department head in that position, and originally, her Welfare Director wages were set at a higher hourly rate than her other wages. Since her work as a department head is part-time, she was not entitled to the raise given to fulltime department heads on January 18th, and since those wages are not on the level scale, her Welfare Director wage was not adjusted, now making it less per hour than her other positions, where she is not a department head. The Commissioners stated their intention was to raise all of Page’s wages by $0.75 per hour. This will be reflected in the salary resolution made later on in the meeting.
With regard to the holiday changes for dispatcher made at the previous meeting, Deputy Auditor Mommaerts questioned the Commissioners on how to handle the holidays previously only listed for the 5pm-1am shifts. Motion by Carlson seconded by Bechen to remove Good Friday, Christmas Eve, and New Year’s Eve from list of holidays paid at 8 hours to all dispatchers, and to pay double-time only to those dispatchers working the 5pm-1am shift on those three holidays. All holiday pay will be granted on the actual holiday (not the observed holiday) for dispatchers. Motion carried. Motion by Bechen, seconded by Faber, that any administrative leave pay granted by the County Commissioners shall only apply to fulltime employees. Motion carried.
Due to major changes to the 2022 Salary Resolution that was included in the January 4th minutes it was moved by Faber and seconded by Reisch to adopt the following resolution updating the 2022 salaries beginning as stated in the motions adopted on January 18, 2022 and February 8, 2022.

The opening of the bids for the Low Slump Dense Concrete Overlay Structure Number 49-069-017 was held as advertised on February 9th. Two bids were received: PCI Roads, LLC $367,573.31 and SFC Civil Constructors $399,941.40. It was moved by Bechen, seconded by Faber and carried to award the contract to PCI Roads, LLC and authorize the chairman to sign the notice of award.
It was moved by Carlson and seconded by Reisch to adopt the following resolution.
RESOLUTION 22-09
WHEREAS, 23 CFR 650 Subpart C, requires initial inspection of all bridges and reinspection at intervals not to exceed two years with the exception of reinforced concrete box culverts that meet specific criteria. These culverts are reinspected at intervals not to exceed four years.
THEREFORE, Miner County is desirous of participating in the Bridge Inspection Program.
The County requests SDDOT to hire Ulteig Engineers, Inc. (Consulting Engineers) for the inspection work. SDDOT will secure federal approvals, make payments to the Consulting Engineer for inspection services rendered, and bill the County for 20% of the cost. The County will be responsible for the required 20% matching funds.
