                The Miner County Board of Commissioners met in regular session on March 7, 2023 in the Miner County Courthouse Commission room.  Members present: Alex Protsch, Tom Reisch, Joe Bechen, Kathy Faber and Mike Clary.  Absent:  none.  The flag pledge was recited.  Motion by Faber, seconded by Bechen and carried to approve the agenda.  No Commissioner report of meetings attended was given.  No persons appeared for public comment.

                The minutes of the February 21st meeting were approved. 

The auditor’s account with the county treasurer showed a February 28, 2023 balance of $5,700,442.80 in all state, county, civil, school and trust accounts.

Auditor Connor presented the 2022 Miner County Annual Report.  She informed the board the report has been published and filed with the SD Dept. of Legislative Audit.

Hwy Superintendent Ron Krempges joined the meeting along with Randy Hofer of Carthage.  Hofer has made a request that the commission consider changing the load limit (40 Ton) on Co. Road 17 from Carthage to Highway 34.  With the closure of the bridge located west of Carthage farmers have a very limited route to haul grain.  Hofer’s request was to increase the load limit on Co. Road 17 to 50 Ton.  Krempges stated that with the set up of 3 axles and a pusher axle less damage to the road is caused as compared to the trucks hauling doubles.  The board will consider Hofer’s request at the April 4th meeting. 

The bid opening for the highway supply bids was held as advertised.  Highway Superintendent Ron Krempges was present. 

Bids per ton for gravel crushing in the Ecklein pit were received as follows:  Rechnagel Construction $2.79 per ton; Eastman, Inc. $2.98 per ton; Bowes Construction $3.24 per ton.  It was moved by Reisch, seconded by Bechen and carried to award the bid for gravel crushing in 2023 to Rechnagel Construction.

The following bids are for a one-year period from April 1, 2023 through March 31, 2024.  Submitting bids for cutback asphalt and emulsion oil were as follows:   Jebro MC3000 $872.01/ton CS1H $403.53 CSS1H $523.53.  It was moved by Bechen, seconded by Clary, and carried to award the bid for cutback asphalt and emulsion oil to Jebro, Inc.

The following firms submitted bids per ton for hot bituminous patch material:  Asphalt Paving & Materials-Huron Plant Class E Type 1 Recycled $79 Class E Type 2 Recycled $81; Commercial Asphalt-Mitchell plant Class E Type 1 Virgin $73, Class E Type 1 Recycled $73, Class E Type 2 Virgin $73, Class E Type 2 Recycled $73;  Commercial Asphalt-Spencer plant Class E Type 1 Virgin $70, Class E Type 1 Recycled $70, Class E Type 2 Virgin $70, Class E Type 2 Recycled $70;  Concrete Materials Class E Type 1 Virgin $85, Class E type 2 Virgin $85, Class E Type 1 Recycled $80, Class E Type 2 Recycled $80;  Bowes Construction Class E type 1 Virgin $88.50, Class E Type 2 Virgin $88, Class E type 1 Recycled $76, Class E type 2 Recycled $75.50. It was moved by Bechen, seconded by Faber and carried to award the bid to Commercial Asphalt, Bowes Construction & Concrete Materials allowing Krempges to use the facility that is most cost conscious for the citizens of Miner County.

The following bids per ton for quartzite materials were received:  Concrete Materials $9.50/ton base material, $25/ton 1 ½– 3” Ballast, trucking $.23/ton mile; Spencer Quarries $10.85/ton 7/16” Quartzite chips, $16.20/ton Rip Rap, $14.85/ton 4”-12” Rock, $9.40/ton base material, $11/ton 1 ½– 3” Ballast, trucking $.17/ton mile double trailer & $.30/ton mile single trailer; It was moved by Clary, seconded by Reisch and carried to award the bid for quartzite materials to Spencer Quarries.

The following bid per pound for crack sealant was received:  Brock White $.73/lb.  It was moved by Bechen, seconded by Faber and carried to award the bid for crack sealant to Brock White.

It was moved by Reisch, seconded by Faber and carried to purchase metal culverts, guard rail, steel piling, bridge decking, steel sheet piling, creosote treated #1 Douglas Fir lumber, and cutting edges during the period from February 1, 2023, through January 31, 2024, off of the bid awarded by Beadle County to TrueNorth Steel.

It was moved by Faber and seconded by Bechen to adopt the following resolution.

RESOLUTION 23-09

WHEREAS, 23 CFR 650 Subpart C, requires initial inspection of all bridges and reinspection at intervals not to exceed two years with the exception of reinforced concrete box culverts that meet specific criteria.  These culverts are reinspected at intervals not to exceed four years.

THEREFORE, Miner County is desirous of participating in the Bridge Inspection Program.  The County requests SDDOT to hire Ulteig Engineers for the inspection work.  SDDOT will secure federal approvals, make payments to the Consulting Engineer for inspection services rendered, and bill the County for 20% of the cost.  The County will be responsible for the required 20% matching funds.

Voting aye:  Reisch, Bechen, Faber, Clary and Protsch.  Voting nay:  none.  Resolution adopted this 7th day of March, 2023 at Howard, SD.

                Krempges also discussed possible equipment purchases, reimbursement to townships for the Small Structure Replacement Program and other highway matters.

                The board recessed as a Board of Commissioners and reconvened as a Planning & Zoning Board.  Todd Kays of First District of Local Governments and DOE Tami Severson joined the meeting to review the draft changes to the zoning ordinance.  A public hearing will be held on March 21st to review the ordinance and to hold the first reading of such.  The board adjourned as a Planning & Zoning Board and reconvened as a Board of Commissioners. 

                Maria Schwader of Legislative Audit reviewed the 2020-21 audit of Miner County finances and operations.  No written comments were presented to the board. 

                It was moved by Bechen, seconded by Clary and carried to enter into executive session (SDCL 1-25-2 (1)) at 11:57.  The board returned to regular session at 12:19.  The board has been informed that Josh Hahn has accepted the position of Miner County Coroner.  Hahn will serve as coroner until December 31, 2024.  Coroner is an elected position which will be elected at the November 2024 general election. 

                Having no further business, the meeting adjourned to March 21st.  Dated this 7th day of March, 2023.
